Payment conditions

1. Foreword

These terms and conditions form an agreement between TRANSGROOM, VAT- BE-0467.389.847-RPR Kortrijk and the persons below referred to as “buyer” who have the intention to buy products for private use or resale. By placing an order, the buyer, declares to have read and accepted these terms and conditions. No deviation from these terms is possible without written consent from TRANSGROOM.

 

2. Object

These conditions describe the sales terms between TRANSGROOM and the buyer regarding the order, service, payment and delivery. They determine how to proceed when you place an order and guarantee the follow up between the two parties.

 

3. The order

Orders can be placed by phone, fax, e-mail or online via the site. When ordering by telephone, TRANSGROOM cannot be held responsible for any mistakes. Articles which are not in stock will not be backordered. In accordance with the law relating to mail order sales to consumers,  a consumer has the right to cancel the order within 14 days of the day of delivery. In this case it is the responsibility of the buyer to return the goods at his expense in their original condition and packaging. Goods which are unsuitable for re-sale or damaged will be refused. This law is not valid for businesses or professionals nor is it valid for consumers buying custom made products such as K Design stickers.

 
4. Price

All information in our catalogues, flyers and price lists are including VAT, unless explicitly stated otherwise. These prices are valid until the next new catalogue or flyer. Transgroom reserves the right to adjust prices, if necessary, as a result of increased manufacturing costs or unfavorable exchange rates. 5. Delivery

All orders are processed with the utmost care and are sent per courier as soon as possible. The order can be delivered to the buyer’s address or to another nominated address. The package will be presented 2 times without extra cost (France excluded), after which a supplement will be payable. Packages will be delivered between 8.00 and 18.00h by an external transport company.

6. Damage

In the event of damage, the buyer is required to inform us within 48 hours  of the delivery. All visible damage must be noted on the delivery note (nature of damage, number of damaged boxes).TRANSGROOM will in this case ensure that damaged goods are exchanged promptly. The buyer is required to send us clean pictures of the damaged products. We kindly ask to preserve the damaged products together with the inner and outer packaging until they are picked up or the claim is accepted. Late declarations or declarations which do not meet the conditions above, will be declined.

 
7. Payment

The buyer can effect payment by credit card, (Visa, Mastercard/Eurocard or American Express) , or by bank transfer in advance of the goods being dispatched. In the case of bank transfer, the goods will be dispatched the day that the funds reach our account. If, after 7 days, the funds have not been received we can no longer guarantee availability. All invoices are payable in cash in Moen, excluding cash on delivery. In case of failure to pay within the prescribed period, the total amount of the invoice will be raised without prior notice with conventional arrears interest of 1.5% per month + increased after notice of default with a fixed penalty clause of 1.2% per month with a minimum of € 75 and a maximum of € 150. This amount remains payable even by late payment. In case of disputes, only the courts of Kortrijk are authorized.

 

8. Recycling costs

Since 01/07/2001, as a result of the recycling law, the sale of some electric and electronic goods attracts a recycling tax. We are obliged to collect this tax on behalf of Recupel v.z.w. who is charged with the task of reusing and recycling defect electrical products. This tax depends on the type of product and will be calculated separately on the invoice.

 

9. Grievances/Returns

We take the utmost care when preparing all orders. If, despite our care, you receive the wrong article you can return it unused, undamaged and in the original packaging. TRANSGROOM will ensure that the goods are exchanged promptly upon receipt of the incorrect item. The cost of the return will be covered by a credit note.

Any other grievances should be notified within 48h.  Later notifications may be refused.

 

10. Warranty

On all our electrical appliances there is a warranty on the no wearing parts. Even after the warranty period, you can always count on our after-sales service.

 

11. Right of withdrawal (sales from a distance)

Goods:  

As a consumer you have the right to revoke the sales agreement between you and us, Transgroom N.V., within a period of 14 days, and to return purchased items. This can be done without giving any reason.    

The withdrawal period shall begin on the day on which you or a third party designated by you and other than the carrier acquires physical possession of the item or goods. The withdrawal period shall expire 14 days after that day.    

TRANSGROOM N.V. undertakes to replace or reimburse any product upon receipt of the returned item.    

Do you wish to exercise your right of withdrawal? Please inform us of your decision to withdraw from the sales agreement by a clearly worded and unambiguous statement (e.g., by e-mail or in writing by post).

Also important:  

  • Exceptions to the right of withdrawal are articles that cannot be returned after opening (e.g., for hygienic reasons or because of damaged packaging), articles that are no longer saleable (either because of damage or wear and tear after use), articles that are customised according to your specifications and wishes for you as a customer (e.g., personalised K-Design stickers) and articles purchased by professionals. This means that these articles cannot be taken back by us. Articles must be unused and returned in their original packaging.  
  • The right of withdrawal cannot be exercised in the case of a sales agreement in our showroom, but only in the case of a remote sales agreement (online).   
  • Transport costs incurred will not be credited.
